Public consultation regarding the revision of the Access Contract

Elia is organising a public consultation on the proposal to amend the Access Contract. In addition to aligning the general provisions and the liability article with those of the Connection Contract, the ‘service Multiple BRP’ - currently determined by a Letter of Intent - will be integrated into the Access Contract.
 

Context

The motivation behind this revision of the Access Contract are the changes required for both the T&C BRP and the Access Contract to assign multiple BRPs on delivery points behind a given access point. This is in addition to the current system already in place to assign multiple BRPs on the Access Point itself. The process to assign multiple BRPs on a delivery point behind an access point is currently used by several market parties in the form of a Letter of Intent, with name ‘Service Multiple BRP’, which has a fixed end date, the amendments to the Access Contract and the T&C BRP ensure that the use of a Letter of Intent will no longer be necessary after the approval of these contracts. 

As requested by market participants, an overlap is foreseen between the public consultation period of both the T&C BRP and the Access Contract so that the two documents can be compared, and relevant feedback can be given on the intersection between the two documents.
We took the opportunity to align, where possible, the definitions and general provisions of the Access Contract with the definitions and general provisions of the Connection Contract, including the liability article negotiated with CREG at the time.

Due to changes in the regulatory context, the references to the Royal Decree of 22 April 2019 containing technical regulations for the management of the electricity transmission system and access to it were removed and replaced by the relevant articles of the Code of Conduct. Also, from now on, the drop-off procedure will also be possible at regional level. For this, the reference to the voltage level in the relevant articles was deleted.

As part of the digitalisation of working methods, the Digital Platform made available by Elia for the storage of contact details will now be used for the collection of contact details, where possible. This also led to adjustments to the Access Contract.

Period

Elia invites all stakeholders to submit any comments and suggestions they may have on the document submitted for consultation.

The consultation period runs from 27 September to 27 October.

After the consultation period, Elia collects all comments and feedback from the market parties. Elia will analyse these comments and integrate them into a consultation report together with Elia’s responses. In addition to the consultation report, Elia will publish the reactions of the market parties (including names) on the website, unless it is explicitly stated that the contribution is to be considered confidential.
