Public consultation on the proposal of exemption from the obligation to procure upward and downward balancing capacity for aFRR separately

Elia is organizing a public consultation on the proposal of exemption from the obligation to procure upward and downward balancing capacity for aFRR separately.
 

Context

Pursuant to the Terms and Conditions for balancing service providers for automatic Frequency Restoration Reserve approved by the CREG on the 10th of August 2023, Elia currently procures both upward and downward balancing capacity for aFRR on a daily basis in a single capacity auction.

However, Article 32(3) of EBGL and Article 6(9) of Regulation 2019/943 provide that the procurement of upward and downward balancing capacity for the frequency restoration reserves shall be carried out separately. In accordance with Article 59 of Directive 2019/944, each TSO may submit a proposal to the relevant regulatory authority requesting the exemption to this requirement.  Such an exemption from the obligation to procure upward and downward balancing capacity for aFRR separately in accordance with Art. 32(3) of EBGL has been requested by Elia, and has been granted by the CREG in its decision B2299 of 9 December 2021. This exemption is valid until 15 December 2024.

This proposal of exemption from the obligation to procure upward and downward balancing capacity for aFRR separately has been developed in the continuity of above-mentioned decision. 

Period

Elia invites all stakeholders to submit any comments and suggestions they may have on the documents submitted for consultation. 
The consultation period runs from 5 September 2024 to 5 October 2024.

After the consultation period, Elia will analyze and integrate in a consultation report the collected reactions from the market parties as well as Elia’s responses to them. Elia will publish on its website this consultation report together with the reactions of the market parties (including names) that are not explicitly indicated as confidential.
