Public consultation on the proposal of review of the Terms and Conditions applicable to providers of restoration service (T&C RSP)

Context 

In accordance with Article 7 of the European Commission Regulation (EU) 2017/2196 of 24 November 2017 establishing a grid code for emergency and restoration of the electricity grid (E&R NC), Elia is conducting a formal public consultation on the proposed changes to the specific terms and conditions of the standard contract for restoration service providers.  
The revision of the specific conditions of the T&C RSP follows CREG's decision (B) 2557 of June 8, 2023 approving the T&C currently in force. In this decision, the CREG indicates that the current T&C are applicable until the end of 2026 and that a new version must be submitted for approval for the contractual period starting in 2027. 

The changes to the T&C RSP are made in the context of design evolutions presented  in the design note that was publicly consulted in 2018. They are complementary to the modifications presented in the public consultation of 23rd of February until the 25th of March.  Elia identified some typos and ambiguities in the different versions (EN, FR, NL) of the documents consulted and decided, in concertation with the CREG to relaunch a public consultation in order to address them.

The current public consultation only concerns the proposed changes. The main changes that are included are:

1. Correction of the formula related to the remuneration reduction.
2. Editorial corrections to improve readability.
3. Alignment between the different language versions.
4. Alignment with the terminology used in the Procurement Procedure.
5. Improvement of the technical terminology used.
6. Clarification that the prequalification test must be performed correctly to be considered Available.
7. Rewriting of the Grid User Declarations.
8. Correction of the reference to the General Conditions.

These T&C will be used for the next tender for the procurement of restoration services for the period starting from 01/01/2027.
The current public consultation concerns only the changes to the Specific Conditions of the T&C RSP.  

Period

Elia invites all stakeholders to submit any comments and suggestions they may have on the document submitted for consultation.

The consultation period runs from Friday 31^st of May to Monday the 1^st of July 2024.

After the consultation period, Elia collects all comments and feedback from the market parties. Elia will analyse these comments and integrate them into a consultation report together with Elia’s responses. In addition to the consultation report, Elia will publish the reactions of the market parties (including names) on the website, unless it is explicitly stated that the contribution is to be considered confidential.
