Formal consultations regarding the draft proposals for the contract of the balancing responsible party (the BRP contract)
Topic
European Commission Regulation (EU) 2017/2195 of 23 November 2017 on establishing a guideline on electricity balancing (hereinafter referred to as "EBGL") requires transmission system operators to submit the terms and conditions for the Balancing Responsible Party (BRP) to the relevant regulatory authority(/ies) six months after the entry into force of the regulation.
Context
Pursuant to the relevant Article 18 of the EBGL, Elia, as the Belgian transmission system operator, must draw up the draft proposal for the Balancing Responsible Party contract (BRP contract) and submit it to the market parties for consultation.
It is important to note that the proposed contract is mainly a restructuring of the existing ARP contract, since the existing ARP contract already fulfils the requirements set out in the EBGL. The proposed changes aim to both align the terminology of the BRP contract with the new terminology as defined in the EBGL and ensure compliance with Article 18 of the EBGL. The proposed BRP contract also takes into account the proposed changes to the Federal Grid Code that will be consulted in parallel.
Period
The consultation period ran from 15 March up to and including 15 May 2018.
