2015 - Results of completed consultation on the Procedure for Constitution of Strategic Reserve (winter 2016-2017)

Context

On December 16th, 2015, in anticipation of an instruction by the Minister to constitute a given volume of Strategic Reserve in accordance with article 7 quater of the Electricity Law, Elia launched a public consultation on the Procedure for Constitution of Strategic Reserve for an entry into force as from February 15th, 2016. All market parties were invited to submit their views on the Procedure for Constitution until January 22nd, 2016.

Following the absence of a Ministerial decree on January 15th, 2016, no additional Strategic Reserve will be constituted for the winter period 2016-2017. This means that Elia will not hold a tendering procedure in 2016 and no new Procedure for Constitution enters into force on February 15th, 2016.

In this document Elia publishes a summary of received reactions to the consultation in order to inform market parties and to give its replies. The received feedback will be taken into account in the upcoming tenders.

A new consultation on a Procedure for Constitution will be held in anticipation of a Ministerial Decree and tendering procedure in 2017; market parties will be invited again to submit their views at that time.

Elia stresses that it can only respond to issues for which Elia is competent. In the present document Elia does not reply to questions or remarks concerning legal aspects or questions which are out of scope of the present consultation.
