Public Utility Declaration Procedure (DUP)¹
In addition to the urban planning permit application that will be submitted shortly for the Walloon Region and the “omgevingsvergunning ” ² relating to Flanders, a demand of Declaration of Public Utility (DUP) will be filed with and examined by the Federal Public Energy Service.
The purpose of this declaration is, as its name suggests, to explain and formalise the public utility of the future connection. A public inquiry will therefore be held over a period of 15 calendar days and will include readings at the valves of each individual commune. Owners affected by the passage of this new underground infrastructure will be sent an official letter (registered mail) by their municipality. The owners in question will be given the opportunity to share their comments/thoughts on this project. These remarks/comments must be sent, preferably in writing, to the municipality.
The final purpose of this Declaration of Public Utility is to grant to Elia a public right of easement for each plot of land directly concerned by the connection. It will in no way change the ownership of the land.
